    Abstract: 向來國際間智慧財產權法權利耗盡原則常有將非智慧財產權法所應慮及的因素列入考量，致使該原則在適用上產生相當程度的扭曲。本文以權利耗盡原則的「對價平衡」法理為主軸檢討國際間權利耗盡原則的適用，試圖犛清傳統上對權利耗盡原則認知及適用的盲點，並重新建構符合「對價平衡」法理的權利耗盡原則。又鑑於世界貿易組織（WTO）下的「與貿易有關的智慧財產權協定」（TRIPS）第六條對於權利耗盡原則的適用型態並未規定，此情形一方面並不符合國際間智慧財產權法和諧化的趨勢，另一方面經濟強勢的已開發國家常以雙邊貿易談判迫使開發中國家向其讓步而採取利於已開發國家的權利耗盡原則，種種跡象顯示「與貿易有關的智慧財產權協定」第六條有統一規制之必要，故本文於確立符合「對價平衡」法理的權利耗盡原則後，以修正條文形式，將最適的權利耗盡法律模式，反映至「與貿易有關的智慧財產權協定」第六條，供未來條文研析的參考。
