    Abstract: 海商裁判與航運發展及當事人權利之保障息息相關。最高法院海商裁判中,案情具有啟發性、法律見解正確、或詞義暢達者,固所在多有。至於語焉不詳、見解仍有商榷餘地、未能兼顧實務運作者,亦不乏其例。 本文蒐集民國七十三年至八十二年海商裁判共計三百四十一則,並進行下述三項歸納分析之研究,期能供學術研究及司法實務方面之參考。1.裁判要旨;2.裁判類型及其件數之統計;及3.重要案件類型評析。
