Abstract:	本計畫包含兩個部分:第一部分是理論分析; 第二部分是實例檢討.第一部分探討要點如下: (1)本研究建立在拙作"客觀的故意概念?-評德國的間接故意理論"(載政大法學評論第48期,頁45 以下.)所確立的幾個基本方向上面:主觀的故意概念、直接故意中先有意欲後有認知、直接故意是典型的故意型態、必要的意欲要素決定制裁的理性、間接故意是擬制的故意、間接故意必須依情況證據綜合判斷;(2)檢討第一級故意- 意圖的功能、意圖要素的作用、意圖與動機的關係、動機和目的的區別、目的與故意的關係 ;(3)分析附條件的行為意思與故意的種類和各種故意分類的意義,例如概括故意與擇一故意、連續犯的概括故意與結合犯的故意、另行起意與犯意改變等等;(4)檢討個人不法理論與目的行為論,同時檢討故意的階層定位,包括故意要素是否該隸屬於不同階層,亦即檢討德國學者Schmidhauser和Schunemann的主張.第二部分藉著實例分析深入檢討各種間接故意理論之間的異同和效用:(1)實例分析完全以檢討我國判決為主; (2)針對有爭議的判例進行檢討;(3)檢索出值得肯定或值得商榷的判決;(4)依犯罪類型的差異檢討各種犯罪故意的判斷標準.
