Abstract: | 本研究嘗試以我國立法研究中較鮮少探討的提案類型-臨時提案-作為研究主軸,並試圖檢視法律提案與臨時提案的異同、院會臨時提案及委員會臨時提案的異同、以及建立一解釋立法委員提出臨時提案的行為論述。 基於國內外針對影響議員提案行為因素的文獻,以及我國立法院政治環境與臨時提案特殊性質,本研究試圖整併後,提出三種影響立法委員提出臨時提案的因素,分別為立委追求提案的政績、立委的選區背景因素、以及立委的議程設定因素三類,以第七屆立法委員為對象,並採用負二項迴歸模型進行驗證。 研究結果顯示,偏好以提案作為立法問政政績展現的立委,確實也偏好提出臨時提案;在立委的選舉背景相關因素中,都會型區域立委較傾向提出更多的委員會臨時提案,原住民立委則較傾向提出更多的院會臨時提案,同時,選區越安全的立委,對於臨時提案的提出也會比較積極,但立委的地方民代經歷則是無助於臨時提案的提出;在議程設定相關因素上,第七屆國民黨立委傾向提出更多院會臨時提案,但民進黨立委則傾向提出更多委員會臨時提案;此外,具有黨職的立委不傾向提出院會臨時提案,但身兼召委的立委則是更加偏好委員會臨時提案的提出。此結果不僅呈現影響兩種臨時提案提出的因素不盡相同外,影響法律提案提出的因素也不必然對臨時提案提出上也有相同的效果。 |
