    Abstract: 在都市保存的過程中,容積移轉制度的建立與執行,解決了財產權分配的問題,讓歷史建築的所有權人願意在其財產權獲得保障的前提下,進行都市保存的行為,但制度設計的交互性質,卻已經在執行階段,逐步衍生出更多複雜的都市管理問題。本文試圖以財產權為討論的中心,就都市保存的目的,分析容積移轉制度在保存過程中所扮演的角色。研究的內容探討了以容積移轉進行都市保存的制度與執行,具有成效的原因以及衍生的制度性問題,並以廸化街街區為案例,對保障財產權的容積移轉行為及政府決策進行分析,提出制度及執行檢討的具體建議。本研究的發現,可提供都市保存的制度與執行層面,更多的討論空間及參考價值。
    The enforcement of urban conservation by transferable development rights has alleviated the property rights problem. The owners of historical buildings under the protection of their property rights are willingness to proceed with urban conservation. However, the institutional design of transferable development rights has its reciprocal nature and results in complex problems for urban management. This paper, based on the viewpoint of property rights, intends to analyze the role of transferable development rights in the process of urban conservation. The reasons of efficacy and institutional problems caused are investigated. Dyihwah street case is employed to address the protection of property rights and government decision-making and institutional choice related to urban conservation so as to provide promising suggestions, and institutional and enforcement issues for further exploring.
