Title:	行政罰法上不法利益之審酌及追繳

Abstract:	於本文所擬之案例一中,乙、丙二人係基於甲公司之指示為行為,因違反水利法相關規定而應受行政罰之裁處者為甲公司,主管機關於定罰鍰額度時,審酌甲公司因違反義務所得不法利益之金額,扣除費用及其他支出後之金額,採取淨額原則,依其合義務之裁量作成裁處一定金額罰鍰之處分,並於所得利益逾法定罰鍰最高額度(於本例為五百萬元)時,得不受其限制,而做出逾五百萬元之罰鍰處分。於案例二中,因乙、丙二人非基於甲公司之指示為行為,主管機關應對此二人以違反水利法相關規定而作成裁處罰鍰之處分,且二人事實上係為甲公司之利益為行為,對於甲公司因違法採取土石而直接獲得之利益總額,主管機關得對甲公司另作成追繳之處分。
