    Title: 唐代的「同居」家庭

    Abstract: 本書所收十二篇論文，從禮之義與禮之制兩個面向，對中華法系與儒家思想的關係有精闢的論述。中華法系（或曰東亞法文化圈）是七、八世紀以後到近代以前，在東亞地區以中國法律（尤其是律典）為主導而發展出來的法律體系。中華法系以唐律為核心，是具有儒學色彩的法系，探討中華法系與儒家思想關係時，律令是最佳的素材，尤其是律典。循由律典去探討儒家思想，即可掌握中華法系精髓之絕大部分，特別是禮之義與禮之制。禮之義，主要呈現在天地之序與人間倫理秩序；禮之制，顧名思義，呈現在禮制方面。本書所收諸篇論文，在以上兩方面課題均有精闢的論述。透過本書的論述，下列幾點值得重視：一、禮是中華法系立法的基本原則，律甚至成為「經」化的刑制。循由公平、正義而追求「平恕」境界，是傳統法文化最可貴的地方。二、儒家經典的理論，如《論語》、《孝經》、《春秋》，以及三禮（尤其是《禮記》）等，是指導歷代立法的主要典籍。三、禮、律的作用，著重教化，斷獄判刑依禮甚於依律。四、從漢武帝以後，法律制度的儒教化，呈現在法典、司法以及家庭等層面，不可忽視。禮的規範，在唐朝的貴族社會交流中有所謂書儀，在日本則為書札禮，均是中古時期儒家思想在法制的重要表現。五、古未必可為今用，但其立法原理原則，如倫理秩序、自然法則，仍可供參考。
