    Abstract: 今年1 1 月9 日立法院內政委員會在國親多數優勢以及主席無盟立委蔡豪的強行表決下， 初審通過兩岸人民關係條例第3 6 條修正草案， 將現行金融保險證券期貨機構赴大陸投資事項， 由禁止類改為許可類。若完成三讀， 金融業只要經過金管會許可， 即可登陸設立分支機構或參股中國大陸銀行。立法院此舉可視為對臺商及銀行業者積極發展大陸市場的壓力之回應， 政府對此發展卻抱持極為負面態度， 表示在兩岸未簽訂監理制度情形下， 銀行赴陸投資將影響臺灣的金融穩定。在兩股勢力相互抗衡的狀況下， 未來政策將朝開放方向發展， 抑或持續採取緊縮立場， 將影響兩岸產業局勢及國內經濟發展， 值此之時， 大陸通過《中華人民共和國外資銀行管理條例》， 又將會對國內相互抗衡的兩股力量產生何種影響， 種種問題均值吾人探討。本文將分就上述幾項問題予以分析。
