    Abstract: 依據損害填補原則，當保險標的全部或部分損失尚未確認，被保險人得不到任何損害賠償。但由於海上保險特性，在短時間內欲證明上述損失係困難重重。此時，拒絕被保險人請求賠償，對被保險人所投入之資金將處於凍結狀態，其將導致嚴重之結果。因此，當保險標的遭受全損已不可避免時，法律上允許認作全部損失，被保險人可請求全部保險金額，實屬客觀之需要。本文即對兩岸海上保險委付之制度加以討論。
