    Title: 一部母以子為貴的法律─如何面對消保法施行細則所劃定之遊戲規則

    Abstract: 本文針對消保法施行細則施行後重大問題加以檢討。商品方面，消保法第七條商品製造人無過失責任，商品範圍界定影響何種商品製造人應負擔責任，使得消保法打擊面增加。關於企業經營者無過失責任方面，細則規定消保法不溯及既往，無過失責任從八十三年一月十三日起算，而「安全或衛生上之危險」細則中也就特定情事認定商品或服務是否具有「通常可合理期待之安全性」，而為求企業研究創新，商品或服務不得僅因其後有較佳之商品服務，而被視為有安全或衛生上之危險，限制企業經營者之無過失責任。定型化契約方面，增加審閱期間之限制及公平互惠原則之明確化定義。郵購買賣方面，範圍縮小，但若干特殊規定使得業者風險增加。總而言之，施行細則使得消保法整體結構更加完整，之後企業界應更加事前防範，謹慎面對消費爭議理。
