    Abstract: 本文嘗試以「對價平衡」之法理基礎，解析權利耗盡原則於本案之適用。本文強調權利耗盡原則之目的，一方面是確保合法專利物之自由貿易與移轉，此為專利法關於「販賣」與「為販賣之要約」等法定排他權之例外。另外，權利耗盡原則亦在確保所有人對合法專利物之合理使用期待，更有防止專利權人不當行使專利權以達重複獲利之目的，此為專利法關於「使用」法定排他權之例外。依本案之案情發展，當屬與「使用」相關之法定排他權之耗盡問題。
