    Title: 智慧財產權的悖論：從言論自由觀點析之

    Abstract: 本計畫旨在探究智慧財產權(intellectual property rights) 的哲學基礎為何。主張電腦軟體應受智慧財產權保護的學者常援引效益論論證(the utilitarian argument) 及自然權利論證(the natural rights argument)，並認為智慧財產權正是為軟體研發者所提供、促其研發的誘因。然而反對智慧財產權的學者則常援引言論自由論證(the free speech argument)，認為智慧財產權係對「獲取觀念或想法 (ideas) 的方法」、「對於觀念或想法的使用方法」及「觀念或想法的表達」(expression of ideas) 施加限制，而這不啻等於限制了思想自由及言論自由！當代反對智慧財產權的理論大將海丁格 (Edwin C. Hettinger) 因而主張：如果我們一方面主張思想自由及言論自由，另一方面又主張智慧財產權，則就會陷入自相矛盾的處境。這表示：如果我們被迫要從智慧財產權與言論自由兩者之中只選擇其一，我們當然應該選擇後者，而非前者──即：我們應該捨棄智慧財產權制度。在本計畫中，我們要問：智慧財產權真的如海丁格所言，會限制了思想自由及言論自由嗎？為此，筆者將首先從消極自由(negative liberty) 及積極自由(positive liberty) 等觀點來對「智慧財產權」及「言論自由」這兩個概念進行深入的哲學分析，期能評斷智慧財產權及言論自由之間究竟是否存有衝突？若答案是肯定的，則究竟何者較為重要？若答案是否定的，則主張兩者間存有衝突的哲學家，其主張背後又是以那些錯誤的假設為基礎？
