    Title: 通訊產業標準機制分析-兼論利害關係人因應紛爭策略

    Abstract: 本文研究的重點是說明一個產業標準的制定，對一個企業競爭力以及社會產業經濟發展具有深遠的影響力。 標準化的優點是可激發業者創新技術或改良現有技術改進產品、加工及服務之適合性，預防貿易上的障礙並促進工業技術的合作，最終更為人類提供了更好更進步的生活品質。
    然而若因為標準制定程序或實施政策中有不夠周延處，導致在實施標準幫助了大廠壟斷市場、阻礙他人的公平競爭，或誘發實施標準人無意識地侵犯到放置在標準內的專利權，或甚至無法拒絕專利權人要求支付不合理的權利金、或遭到歧視不公平的對待(授權)，各利害關係當事人因此產生利益衝突而爭訟。實施標準人為解決與技術權利人間的爭議，需付出很多時間與社會成本，然後把這些爭訟成本轉嫁到消費者身上，使得消費者最後須付出了更多的交易成本。如此不符合經濟效益的結果， 讓一個立意完善的產業標準機制反成了洪水猛獸，足以讓一企業失足於市場上。 所以本文認為此產業標準所衍生的問題與影響力很大，深深值得社會關注與檢討。
