Title:	保險契約之內容控制之適用法律與構成要件

Abstract:	上訴人（即被保險人）主張以所有之營業用系爭車輛與被上訴人（保險人）訂立任意第三人責任保險附加雇主責任保險（下稱「系爭保險契約」），雇主意外保險總額為每次事故新臺幣（下同）一百萬元。系爭車輛於保險期間內由上訴人受僱人李○○為執行業務而駕駛，在國道上因車輛故障而停放於路肩察看車況及放置故障標誌，經訴外人所駕駛之大貨車撞擊後死亡，發生死亡職業災害。上訴人受賠償請求，經通知被上訴人參與調解，為被上訴人所拒，上訴人嗣與李○○之兄弟姊妹達成和解，並給付職業災害補償、損害賠償及其他一切損害共一百一十萬元。爰依系爭保險契約求為判命被上訴人給付上訴人一百萬元本息之判決。被上訴人則以：李○○死亡之原因，與系爭保險契約條款所載因被保險汽車發生意外事故之要件不符。且縱認保險事故已發生，但系爭保險契約雇主責任保險條款（下稱「系爭雇主保險條款」）第四條第一項約定所載每一個人之保險金額係指在任一意外事故內，對每一個人傷害於超過強制汽車責任保險給付標準以上之部分所負最高賠償責任而言。而強制汽車責任保險死亡給付標準為一百六十萬元，上訴人給付之賠償金為一百一十萬元，未高於上開標準，被上訴人並無理賠之責。又基於保險制度對價平衡原則，不得要求被上訴人承擔超出保費對價之風險，況系爭雇主保險條款並無違反公平合理、平等互惠及誠信原則等語，資為抗辯。
