Abstract:	凡關於法律關係之存在及形成有所爭執，而請求國家機關裁斷之行為，謂之爭訟之提起。提起爭訟之後，以國家權力裁斷其爭執，而為決定之行為，謂之裁判。自提起爭訟而至裁決期間之一切行為，稱為爭訟程序，或簡稱爭訟。行政爭訟為關於行政事件之爭訟，與民事訴訟刑事訴訟相對稱。行政爭訟，則係關於行政法規適用之爭訟，其目的在於矯正官署之違法或不當處分，以保護人民之權利或利益，而貫澈法治主義之主旨。故行政爭訟，亦稱行政救濟。
