    Title: 唐代的「同居」家庭－兼論其與戶籍、財產的關連

    Abstract: 本文從四個方向分析同居家庭，首先是解析「同居」的法制意義，論述其由秦律到唐律的演變原因，並說明「同居」的用法，及這個創造性語辭與人們慣用的家有何異同。其次係對同居家庭的民間類型，做個整理與比較，看它如何在共財的基礎上，表現各異其趣的特色。復次則針對戶籍問題，觀察籍別財同、戶同財異之因由，及其與課役的關係。最後要討論同居家庭的共財性質，主要在分清共財是何種權利，共財親適用範圍有多大。唯有先澄清共財的意義，才能據此以論家庭財產制的相關議題。本文以分析共財為基調，至於由其延伸的家庭財產制，則俟另文再論。
