    Abstract: 獄訟者國家對於民刑訴訟案件之審理與聽斷也。中國以禮治國，刑以弼教，民事刑事之分不著也；然深察之，此論亦未盡然，罪分公私，由來甚久，文別典律，其例甚明；即揆之周禮，告分獄訟，以區民刑。大司寇之職，『以兩造禁民訟，入束矢於朝，然後聽之；以兩劑禁民獄，入鈞金三日，乃致於朝，然後聽之。』鄭注曰：『訟謂以財帛相告者』，乃民事；『獄謂相告以罪名者』，乃刑事。大司徒之職『凡萬民之不服教，而有獄訟者，與有地治者聽而斷之，其附於刑者歸於士』；媒氏之職，『凡男女之陰訟，聽之於勝國之社，其附於刑者歸於士』；是民刑訴訟復各有分掌焉。獄訟者繫萬民之禍福，關全國之安危，處置固不可不慎也；是以獄訟之事，乃一繁複之裁判組織與程序；若析而言之，則管轄、審級、聽訟、斷獄、囚繫、刑訊、緩刑、宥赦之節均屬之。茲以此為範疇而分加論述，以明其演變之因跡焉。
