Title:	專利授權限制競爭條款之規範－以公平交易法草案為中心

Abstract:	本論文討論主要問題係專利授權契約所附限制競爭條款是否應以公平交易法規範之，此涉及現行公平交易法草案第四十五條：行使專利權之正當行為不適用本法規定之解釋。雖公平交易法尚未通過，但在歷次討論中草案第四十五條均未受到重視。本文認為如按照原草案通過第四十五條之規定，且無補充之子法時，將來在執行上將會產生困擾，本文特就專利授權契約上所附之限制競爭條款是否適用公平交易法或其適用之範圍為何？加以探討。
