    Abstract: 明制，凡朝廷有大政事，或缺文武大臣，必令廷臣會議，以共衡可否，然後請旨定奪。其關於事項得失利弊之討論者，謂之「廷議」；關於人事陞補之擬請者，謂之「廷推」。茲專論廷議。明代初年，天下初定，百事待舉，故凡朝儀、郊祀、官制等事，多令翰林儒林或中書省臣議行。(註一)然當時會議皆係皇帝各別交議，未為定制。明代廷議之成為定制始於洪武二十四年。大明會典：「洪武二十四年令：今後在京衙門，有奉旨發放為格為例及緊要之事，須會多官計議停當，然後施行。」(註二)廷議之作用，一則集思廣益，求事理之斟酌至當(註三)；二則可廣耳目，防臣下之專擅欺蔽(註四)。而更重要之原因，則為求各衙門間之互相連繫、溝通彼此意見。按洪武初年，本有中書省之設置，中書省設左右丞相，以出納王命，助理萬機，丞相之下，設六部尚書以分行政務。洪武十三年，太祖藉口丞相胡惟庸謀反，廢中書，罷丞相不設，析中書之政歸於六部。六部尚書各自在本位上執行職務，各別向皇帝負責，皇帝之下，六部之上，無任何承轉機構，總持其間。因此各部相牽連之事，不免彼此參差，意見相左。故凡關係二部以上之事務，或僅關一部而事體重大尚書不能決者，即常召集廷議，以共衡可否，會商解決。
