    Title: 羅爾斯的正義理論：自由與平等的調適

    Abstract: 本文旨在探討當代著名哲學家(John Rawis, 1921∼)的正義理論，並擬以「自由與平等的調和」作為全文的重心。「正義」是西方政治思想上的古老課題，究竟何謂「正義」，向來眾說紛紜，莫衷一是。然而任何正義的學說總與我們該如何去看待「人」、看待「社會」（人與人、人與群）有關、依照羅爾斯的看法，作為西方憲政民主體制的主體－「公民」、在民主思想的傳統裡，通常都被假定為具備遵守正義原則及追求個人理性人生目標的二項道德能力。 於是每位公民都被假定為自由、平等的道德主體。然而遺憾的是，在現實世界裡，由於各種資源的相對有限性，以及人們人生觀及價值觀的歧異，人與人間難免會有許多紛爭（利益及價值之爭），面對這些紛爭，如果我們無意用國家的強制力來敉平紛爭，也不滿意於以強弱眾寡（功利主義即是）作為息紛止爭的方法，那麼唯一的途徑，只有將傳統的契約論重新構作，以期建構更合理的正義原則，作為處理紛爭的準則。 依羅爾斯的構想，是將上述那些自由平等的道德人，設想處在一特殊的假設情境－原初情境(original position)下，達成某種協議，由於該協議是在一公平合理的情境下達成的，是以該協議便是最合理的(reasonable)，也是仲裁紛爭的正義原則。本文在處理上，除第一章導論說明羅爾斯所關懷的問題外，第二章是對羅爾斯的論證基礎加以說明，第三章乃是探討其論証方法，第四章則主要涉及自由及平等如何調和的問題，第五章則以本人的幾點研究心得作為結論。
