    Abstract: 內政部訂定建築基地法定空地分割辦法(以下稱「分割辦法」),作為法定空地分割執行之準據。依分割辦法第五條規定,申請建築基地法定空地分割,應檢附直轄市、縣市主管建築機關准予分割之證明文件(即法定空地證明)。然同辦法第四條復規定,建築基地空地面積超過依法應保留之法定空地面積者,其超出部分(以下稱「超出空地」)之分割,應以分割後能單獨建築使用或已與其鄰地成立協議調整地形或合併建築使用者為限。
