Title:	中美兩國學生懲戒制度之比較研究

Abstract:	本研究係以個案研究、比較研究與文獻分析為研究方法，旨在比較中美兩國，面對中等以下學校學生的問題行為時，如何兼顧學生基本權利之保障與學校教育之特殊性質，制定一套既合乎法治國原則，又符合教育目的之學生懲戒制度。在研究架構上，首先究明中美兩國公立學校與學生之法律關係，其次說明懲罰教育上與法律上之涵義，再則探討中美兩國現行的學生懲戒為類型與實施程序，最後論述美國公立學校對學生實施搜索時，所面臨的憲法上爭議。
