The Cyber Café is one of the most noticeable phenomena of Taiwanese society in the 21st century. Because of its potential harm to teenagers, the Taipei City Government has imposed legislation to curb the Cyber Café’s vile environment. But this legislation is still subject to constitutional review though it has been passed by the city council. According to the principle of “Rule of Law”, democracy is not the only value in our public policy, and human rights play a more important role. This article tries to build a definite normative relation between regulation of Cyber Cafés and teenagers’ basic rights. Teenagers’ basic rights have not received enough respect in this regulation, and the author has pointed out its errors and misunderstanding of Liberalism. Two conclusions are reached after the whole discussion, First, this regulation is not necessary to protect teenagers from relevant harm, since the Taipei City Government still has other regulative tools to accomplish the same goal. Second, some stipulations of this regulation impose excessively severe restrictions on teenagers’ basic rights.
