Title:	公同共有債權之行使

Abstract:	民法第1151條第1項規定，若繼承人有數人者，於分割遺產前，該遺產乃為繼承人全體所公同共有。若遺產中存有對第三人之債權時，該債權自亦由繼承人全體所公同共有，惟此等公同共有之債權究應由公同共有人全體共同行使？抑或得由公同共有人中之一人單獨行使？在此即生問題。更確切地說，有關公同共有債權之行使，除公同關係另有訂定或法律另有規定外，依據民法第831條準用民法第828條第1、3項等規定，應由公同共有人全體共同行使或得公同共有人全體之同意行之。然而，民法第828條第2項在此卻賦予準用民法第821條規定之可能性。從而，公同共有債權得否由公同共有人中之一人單獨行使，在此即生疑義。
