    Abstract: 日本政府在2008年通過「宇宙基本法」，將當原本只限於「非軍事目的之太空發展」，調整為「得以開發利用防衛目的之太空發展」。事實上，日本太空產業在2000年起逐漸走下坡，從業人員亦隨之持續減少。日本政府為了挽救發展面臨瓶頸的太空產業，而推動「宇宙基本法」的立法作業，要為「不得進行軍事目的之太空發展」解套，帶動太空產業的活絡。因此，法案的焦點在於將「堅持和平利用太空」的基本政策，調整為「凡有助於維護日本國家安全而行使於防禦目的之太空發展，均得以開發利用」。這是日本國會首次立法強調振興太空產業之重要性，明確太空產業的法律定位。「宇宙基本法」的成立，不只可振興太空產業，還可策略性推動外交工作。日本政府的構想是計畫將目前與外交工作無法掛勾之太空發展，透過「宇宙基本法」來推動太空事業之外交政策，提供各國災害監控衛星情報等，增進國際合作關係。此外，日本政府也進行改造執行太空政策之體制，目前分設於文部科學省、國土交通省、經濟產業省、總務省等各單位下之太空政策推動機構，將進行裁撤整合。而在內閣官房下新設總指揮太空發展政策之「宇宙開發戰略本部」，運用政府的力量主導推動國家既定政策太空事業之發展。
    Japan’s space policy has complied with the Constitution’s pacifist principles. Space development has been carried out with exclusively peaceful purpose since 1955. The word “peaceful purposes” was strictly interpreted to mean that Japan could use and exploit space only for “non-military” purposes. After two decades of inconsistency between “the Principle of peaceful use of space” and reality of militarized space activity, the new Japanese space law enacted in 2008 lifted the ban on the use of space technology for military purposes.
