    Title: 夜宿凱道豈是農民的宿命！---從土地徵收條例修法探究土地徵收之結構性問題

    Abstract: 當「怪手摧毀良田」喚醒各界重視政府浮濫徵收土地問題後，速修「土地徵收條例」成為杜絕各級政府遂行「農地」「圈地主義」的燃眉之急；當政府機關在選票至上的操作下，行政部門與立法部門勾稽，捨逐條討論，採逕付二讀，逐條表決，在執政優勢人海戰術下，「假修法，騙選票」敷衍了事的愚民。以土地作為空間規劃的平台，位居關鍵地位，土地應承擔更多的使命，則面對現行土地徵收之結構性問題，如何制定一兼顧實質正義與形式正義之完善法規，則為土地徵收條例法規修法之核心課題。本文就土地徵收條例之修法過程，探究思索土地徵收問題之根源所在，則如何跳脫「金權城市」的枷鎖，重振社會公義，應有之醒悟：一、疼情土地資源－真實面對土地徵收之結構性問題；二、土地政策之救贖－徹底瓦解國家威權體制與政客官僚之共犯結構；三、反成長聯盟的聖戰－唾棄國家機器意識形態的安撫與打壓。而夜宿凱道不該是農民的宿命，在臺灣，土地正義的力量正逐漸茁壯中，真正的民意終將制裁政客與官僚，大地的守護者－人民亦終將成為國家機器權力巨獸的領航者，帶領國家駛向康莊大道，共創社會福社。
