    Title: 受僱人盜領客戶存款之僱用人責任

    Abstract: 銀行之受僱人若係持有存款戶之存摺、印章與取款密碼，而以存款戶之名義受領銀行存款返還之給付者，因此時發生如同對存款戶給付之效力，所以存款戶尚未受有損害。實際上存款戶損害之發生，乃導因於該受僱人進一步表見代理將提領之款項轉匯至其個人或第三人帳戶之行為。銀行之受僱人承擔理財專員之職務，明顯有助於其取得存款戶之存摺、印章與取款密碼，進而實施以存款戶之名義表見代理將提領之款項轉匯至其個人或第三人帳戶之侵害行為，因此符合「與受僱人職務之執行有關」之要件，以致該當民法第一八八條第一項之規定，令作為僱用人之銀行亦對存款戶負擔侵權行為損害賠償責任。此外，基於銀行與存款戶間消費寄託之債之關係，針對上開受僱人之侵害行為，銀行因此同時對存款戶負擔債務不履行之損害賠償責任。
