Abstract:	宋代的阿云之獄，引發了一場犯罪自首成立與否的大爭論，古往今來，史無前例。主要爭論之點為阿云所犯的「謀殺已傷之罪」有無「所因之罪」，因而是否得以成立自首。反對論者與贊成論者，得分別以司馬光與王安石為代表。法制的繼受，並非易事。宋行唐律，其犯罪自首條的規定亦係經典之作。但美中不足而遺憾的是，在宋代，法條的解釋跟不上法條的適用，因而引發了一場犯罪自首成立與否的大爭論。在今天，現刑犯罪自首該條的繼受有欠妥適，從而使狡黠之徒得恃以犯罪或有所遁飾，司法者也從而有難以因應之苦。
