    Abstract: 本文乃接續前文「專利法之基本用語與法律體系概述」的主題，將之延伸至著作權法的領域，嘗試建立讀者對於著作權法體系下重要觀念與用語的基本認知。特別是以比較法的觀點呈現，盼讀者能以宏觀的視野透析歐美著作權法的發展。著作權法自伯恩公約（the Berne Convention）起始，國際間各國已朝著作權法規範「和諧化」（harmonization）努力，而後，為因應數位時代的來臨，面對新興科技對於著作權保護的衝擊或潛在影響，智慧財產組織（the World Intellectual Property Organization，WIPO）亦致力於促進各國數位著作權規範的建立。世界貿易組織（World Trade Organization，WTO）亦本於伯恩公約的基本架構，以「與貿易相關之智慧財產協定」（Agreement on Trade-Related Aspects of Intellectual Property Rights, Including Trade in Counterfeit Goods, the TRIPS Agreement）為藍圖，整合現代著作權法的體系。由於著作權法之權利體系頗為複雜，歐美著作權法向來呈現不同的法價值思考，本文擬就四個方向建構為文之方向與內容，以協助讀者達成法學英文的學習目標；第一部分，本文將簡述美國與歐洲著作權體系間價值認知與權利結構之差異；第二部分，本文將聚焦於著作權保護適格與要件，並提及美國著作權判例法所發展出的相關法原則；第三部分，本文則著重於著作權法體系下著作財產權之介紹；第四部分本文針對國際著作權法關於權利的例外或限制加以說明，並區分觀察各國著作權法關於權利例外與限制的類型，最後再就美國著作權法的「合理使用」規範加以解析。
