    Title: 論核准區段徵收抵價地比例之法律性質

    Abstract: 區段徵收之地價補償，得以領回抵價地方式為之。抵價地總面積與徵收總面積之比例，以百分之五十為原則；但因情況特殊，經內政部核准者，得調降至百分之四十。因內政部核准抵價地比例之法律性質及其得為救濟之時點，向於實務上見解分歧，是值釐清。本文就土地徵收（區段徵收）當事人──徵收權人、需用土地人、被徵收人三者之地位與法律關係及區段徵收程序等，分析抵價地比例之作用，進而認為對抵價地比例不服之被徵收土地所有權人，得於徵收公告後，以利害關係人名義提起行政救濟。至抵價地比例雖揭載於直轄市或縣（市）主管機關之徵收公告中，然基於訴願法第十三條規定，其仍屬內政部所為行政處分。
