Abstract:	我國各級地方政府之公有財產管理實務上，不乏以標租、設定地上權及委託經營等方式，將公有公用及非公用財產提供民間使用之例。其目的具有多元性，有為減輕政府履行公共任務所需人力及財政負擔者，亦有為活化公產之資源有效利用者。在現行法制下，地方公產提供民間使用涉及之法規眾多。在此等由中央及地方法規所交織而成的綿密法制框架下，地方政府於具體個案中通常係透過「契約」之法律形式，將其公有財產提供民間使用。從而，在公產法制上，乃呈現出「法律框架」及「使用契約」之雙層規範架構。本文從法制、學說，以及行政與司法實務角度出發，以臺北市為例，分析地方公產提供民間使用之類型，檢討對應之法規適用正確性問題，並且肯定在公產使用契約之領域，行政機關原則上享有契約形式之選擇自由。對此，法院應予尊重。
