Abstract:	基於任務性質、法令限制,或政策考量等因素,國家往往不得或不宜採行真正意義之完全民營化,將行政任務之執行責任全部移轉予民間。取而代之,部分民營化為現今各國最普遍採行之民營化類型。其特徵在於,行政任務係由「公部門」與「私部門」共同合作達成,即所謂之「公私協力」。至於合作模式,現行法制中之公權力委託、業務委外、行政助手、公民合資經營事業、民間參與公共建設,以及公私合作管制等,皆屬適例。憲法對於行政權以公私協力方式為之,基本上採取開放性態度。在公私合作法律關係之具體建構層次,則有賴合作行政行為法之深植與發展。
