    Abstract: 在概念理解上,國家任務毋寧為公共任務之下位概念。德國公法學者Hans Peters即指出:「凡是攸關公衆或公衆對其實現存有利益之事務,吾人皆可稱為公共任務。」公共任務之執行,並非以公權力主體為限,自然人或私法人亦可為適當之主體。是以,私人得以基本權利主體之身分從事公共任務,公共任務係屬基本權利之保護範圍,國家並不具有「公共」之獨占。例如,水、電、瓦斯的供應,因對於人民生存照顧具有重要性,一方面屬於公共任務,另一方面則又為憲法營業自由之保護範圍,原則上可由任何人行使之。而國家任務,係指在合憲秩序下,透過「實定法規範」賦予國家執行權限之公共任務。準此,國家任務之概念實較公共任務為狹,僅有那些透過法規賦予國家執行權限之特定活動領域,始具國家任務之特性。再者,若吾人從權力分立之角度思考,則國家任務之下又可細分為立法任務、行政任務與司法任務。
