Title:	把你的案件寫進我的回憶錄？律師的保密義務

Abstract:	知名藝人甲與其妻乙的離婚訴訟，受到新聞媒體高度關注。甲委任的律師A某日接到記者B來電表示「我已經知道甲和丙女星有外遇，我只是想要問你否不否認」，A聽了沉默不語。隔日，新聞媒體大幅報導「甲與丙外遇致乙提離婚之訴，獲甲身邊親近人士予以證實」。該訴訟判決確定後，A與甲間的委任關係結束。十年之後，有出版社找已擔任律師三十餘年的A撰寫其律師生涯回憶錄。其中一個章節A以甲、乙當年轟動一時的離婚之訴為主題，在書中寫道「甲當年確實與丙外遇，所以乙才堅持提起離婚之訴。雖然我身為律師對當事人有保密義務，但是這已經是十年前就結案的案子了，而且這件事情那時候新聞媒體就已經大幅報導，所以我可以寫在這裡」。A在回憶錄中並表示「我曾經看過甲帶著丙一起來事務所找我，丙還抱著一個小嬰兒，但是我沒有問這個嬰兒跟他們是什麼關係」。回憶錄出版之後引起軒然大波：仍為知名藝人的甲痛批A沒有職業道德，其前妻乙也對記者表示「真可惡，原來他們那時候就有小孩了，我到現在才知道！」A則回應「甲有外遇是媒體早已報導的公眾周知事實，至於那個小嬰兒我從頭到尾沒有說是誰的小孩，是媒體及乙自行臆測說是甲、丙的小孩，與我無關」。
