    Title: 從美國專利訴訟的專家證人制度談對我國專利侵權訴訟之借鑑

    Abstract: 專利制度在鼓勵技術發明，並透過授予專利權的方式來換取發明人揭露其發明內容。為獲得專利權，發明必須要符合可專利性要件。專利法通常要求發明必須可供產業利用、新穎的、以及非顯而易見的（或進步的）。為讓公眾瞭解發明內容，專利法也要求發明說明的內容必須讓具有通常知識者得據以實施該發明。當發明人獲得專利權後，其可對侵權者行使排他權。例如根據我國專利法第58條第1項，「發明專利權人，除本法另有規定外，專有排除他人未經其同意而實施該發明之權」。針對物品專利，同條第2項定義「實施」為「製造、為販賣之要約、販賣、使用或為上述目的而進口該物之行為」。針對方法專利，同條第3項定義「實施」為「使用該方法」或「使用、為販賣之要約、販賣或為上述目的而進口該方法直接製成之物」。一旦侵權者違反排他權，專利權人有針對侵害行為的損害賠償權、排除侵害權、和防止侵害權。
