    Abstract: 本文一開始回顧戰後臺灣法學研究的發展,說明各世代如何發展回應社會的法學知識。近來為了進一步面對法律繼受之下的法律與社會落差,學者開始研究日常生活中的法律,爬梳法文化的變形與轉化。唯有在法文化的變與不變當中,才得以掌握臺灣法治社會轉型的現狀與未來,而這可以放在人權的轉譯上面進行觀察。最後本文以日常生活中女性平等繼承權為例,說明研究者應該以日常生活中的法律實踐(文化實踐)為研究對象,理解人們現實中的困境,並且著重於發掘關係(所謂的加害人與被害人)中的人們彼此的「抵抗」行動,所抵抗者並非對方,而是背後更大的結構性因素。
