Abstract:	金融領域糾紛因具有高額紛爭少、小額事件多之特色,故爭議解決應而認為在爭議解決上應力求簡單迅速,且不應使消費者為實現權利而付出過高成本。又隨金融商品複雜化、且多樣化,需要高度專業性以解決問題。是以,金融爭議端處理與一般消費爭議相較,乃有其獨特性。所謂金融ADR正替代性紛爭解決機制(ADR)係透過有效率的訴訟外爭端解決機制,達成紛爭快速、有效解決之目的,減少法院訟累。是以,正如英國FOS之設立目標與宗旨,金融消費爭議解決機制ADR乃為協助消費者與金融機構公平、迅速、合理且彈性而簡易地解決金融消費爭議。然過去我國金融爭端解決機制ADR之運作並未能完全達到上述目的。但隨金融消費者保護法之通過,未來應可期待國內相關機制建立後,能協助金融爭議之有效解決。"
