Title:	服貿抗爭的刑法議題

Abstract:	服貿協議在不透明且未經充分討論的情況下，在立法院通過備查，引發起社會非常大的爭議，進而有學生於3月18日衝入立法院內，佔領國會議場迄今；接下來又發生學生於3月23日衝入行政院內，佔領行政院辦公室，行政院長江宜樺及警政署長王卓鈞隨即於3月24日凌晨下令鎮暴警察驅離學生，引起流血衝突的事件。雖然事件尚未結束，但很顯而易見的是，其中已經涉及諸多刑事責任議題，考量刑法所附帶的犯罪宣告及刑罰制裁效果，這次學運最後很有可能必須透過刑事法院具體地確認刑責，雖然諸多事實並未完全釐清，例如究竟是那位警察採用致命性手段攻擊靜坐學生？總統府及行政院高層是否在驅趕行動中扮演關鍵性角色？但初步已經可以整理出一些不涉及具體行為人的抽象刑法議題，筆者即以這些抽象議題為中心，在有限篇幅內說明筆者的初步看法。
