Abstract:	隨著新興科技的發展與交易日漸複雜，跨境或複數主體分工下之專利相關發明的非法實施，逐漸浮現於各國之司法管轄上。此類非法實施的特徵，常因跨境或複數主體分工之因素，依屬地主義與全要件原則之法理，縱有一部實施於權利保護國，或各分工參與者確已為一部之實施，而獲有實施的市場經濟利益，專利權人仍無由尋求專利法之適度救濟。因此，本文藉由智慧財產法院一○三年度民專訴字第一一二號判決為例，探討跨境或分工非法實施，可能因屬地主義與全要件原則之僵化適用，所產生的問題，以及如何利用各種理論基礎，調和前述法理影響專利侵權評價的嚴峻性，以重新思考專利侵權法制因跨境或分工非法實施所受之挑戰，以及如何尋就符合專利法本旨的評價模式。
