Abstract:	甲明知成年之乙女為弱智之人，竟不顧乙女之反對及推打，於違反乙女之意願下，強行以手指及其性器官進入乙女之性器官，對乙女強制性交得逞。乙女及其父母丙、丁，分別依民法第195條第1、3項訴請甲賠償非財產上損害。甲抗辯乙女為成年人，丙、丁已非監護人，不得主張民法第195條第3項請求非財產上損害賠償。
