Title:	人壽保險契約停效前的危險變更，可否作為復效可保條件的審查事項?

Abstract:	甲於民國（下同）103年1月27日以自己為被保險人，向A人壽保險公司投保20年期定期人壽保險，契約終期為123年1月27日。嗣後甲於同年5月27日因故未繳交續期保費，該保險契約依法自寬限期30日終了之翌日即103年6月27日停止效力。後甲於104年6月25日申請復效，並依A公司要求提供可保證明。A公司以甲自103年5月至104年2月間於B、C醫院有頻繁就診紀錄，且未於復效申請時提及，僅提供B醫院病歷，未提供C醫院病歷為由而拒絕復效。嗣後甲檢具其在C醫院的病歷，起訴請求A公司將該契約復效，A公司仍然拒絕。甲主張其申請復效係在保險契約規定之2年期間內，而伊雖於停效後的103年5月28日至104年2月4日多次至醫院心臟科就診，惟其於停效前103年4月12日即在B醫院經診斷為狹心症、高血壓、冠狀動脈心臟病，亦即伊於103年6月27日停效前即至醫院診斷有狹心症、高血壓、冠狀動脈心臟病等心臟病史，以此對照停效後伊持續就醫之門診或住院診斷相同，是甲上述病史在保單有效期間即已存在，其危險程度在停效期間並沒有重大變更，被告拒絕甲申請復效乃違反規定。1請問何者之主張為有理由？
