Abstract:	除了交通事故受害人之外，被保險人亦為強制汽車責任保險理解為保護對象之一。臺灣強制汽車責任保險法立法時忽略此點，導致被保險人在強制保險中的地位與應有權利不明。本文以「保護被保險人」為主軸，檢討現行法關於保險給付要件、給付對象、給付項目、保險代位、數車事故的責任分擔以及和解同意權等諸多規範，不符合被保險人的保障需求之處，並說明被保險人的保障與本法保護受害人的目的並無衝突。
