Title:	全民健康保險法下保險人代位求償權之再思考——由八仙塵爆事件之代位求償談起

Abstract:	八仙塵爆發生後，衛生福利部中央健康保險署遂針對醫療費用向八仙樂園、責任保險公司與活動主辦單位瑞博國際整合行銷有限公司負責人等人，代位傷者就健康保險給付與墊付之醫療費用部分起訴為代位求償。此一作為，使健保署得否依健保法第九五條，向公安事故之加害人行使代位求償權之爭議再起。本文試自全民健康保險之保險與被保險人間之法律關係性質、全民健保之損失填補性質及保險人代位求償權之適用範圍與其衡平法上之法理基礎，析論此一問題，並提出全民健康保險法第九五條之修正建議，冀為此一爭議，尋求永久解決之道。
