Title:	日本最高法院之功能及其法官任命之問題點

Abstract:	本文首先分析日本最高法院之三大功能，其一為憲法法院，其二為最上級審法院，其三為司法行政統合機關，及其二大重要輔助機關，其一為調查官，其二為事務總局，說明最高法院整體運作及結構。其次再從日本最高法院法官及院長之資歷要件及任命慣例，說明十五名法官（含院長）其出身類別及提名方式已趨高度類型化、固定化，尤其職業法官出身占有六名比率，其資歷要件及選任途徑，如出一轍，殊難想像。最後分析日本最高法院法官及院長任命之問題點，結論認為已影響日本司法民主化，並已干預司法權獨立，甚至危及違憲審查權之行使。日本最高法院此種保守官僚主義作風，近年來遭致嚴厲批判，各界期待其應積極對應現代政治、社會之結構性變遷而充分實現憲法價值及國民需求。值此臺灣司法改革在即，日本此一負面經驗，正可作為臺灣今後司法改革借鏡，避免重蹈日本之覆轍。
