Abstract:	言論自由在於保障資訊之自由流通，使人民有取得充分資訊及自我實現之機會，而「商品標示」與「商業廣告」係提供商品客觀資訊或利用傳播方法以宣傳商品效能，具商業上意見表達之性質，應受言論自由之保障。惟國家為維護國民健康或保護消費者，常以「標示管制」或「廣告管制」作為商業言論管制之手段。有鑑於商業言論管制對人民之言論自由與營業自由均生一定影響，本文將以日本之法制經驗，針對臺灣現行商業言論管制之合憲性與合法性進行檢證。本文結論認為，立法者於規範形成之際，雖享有制度形成之自由，惟就市場上私經濟主體之言論自由與營業自由，仍應符合憲法基本原則予以保障，並兼顧經濟市場之公平競爭與消費者權益保護等因素，方能通過嚴格之違憲審查。
