Title:	保險業管制下保險招攬勞務契約定性及勞工退休金提撥制度之合憲性與合法性論議

Abstract:	處今商業市場高度自由開放之時代，無論係保險業管制、保險招攬勞務契約法制或現行勞工退休金提撥制度等面向，均有與時俱進之必要。於司法院釋字第七四○號解釋針對「保險業務員招攬保險勞務契約是否為勞動契約」之爭議作成初步判斷之際，本文以日本法制為比較基礎，就臺灣保險業管制、保險招攬勞務契約定性以及勞工退休金提撥制度等進行合憲性分析，並就保險業勞工退休金提撥行政之法執行提出合法性之判斷要素，於結論中認為：(1)國家保險業管制之目的與手段應予多元化、(2)勞動契約之從屬性要件應以法律明定、(3)勞工退休生活保障容有契約自由及私法自治之可能、(4)勞基法與勞退條例之法規範應符合法律明確性原則與比例原則、(5)保險業勞工退休金提撥行政之法執行應遵守職權調查原則與行政謙抑主義，並供今後國內學理與實務參考。
