Title:	專家層級結構或權威決斷體系─小額訴訟制度的反思

Abstract:	在民事訴訟法（下稱「民訴法」）體系中，有關財產權訴訟事件，分為小額、簡易及通常訴訟程序。依民訴法第436-8條規定，關於請求給付金錢或其他代替物或有價證券之訴訟，其標的金額或價額在新台幣（下同）10萬元以下者，適用小額訴訟程序（下稱「小額程序」）；其標的金額或價額在50萬元以下者，得以當事人之合意適用小額程序。小額程序雖然訴訟標的價值較低，但往往與人民日常生活密切有關，例如：因車禍事故而請求損害賠償，或小額消費借貸款紛爭，如有訴訟之必要，常以小額程序進行。就解決紛爭為訴訟重要功能之一而言，小額程序運作成效的優劣，攸關司法體系功能是否有效發揮，自不容輕忽。
