Title:	侵害生命、身體法益之修法芻議

Abstract:	法務部為廣納社會對於刑法修法的意見，在2017年3月21日張貼刑法部分條文修正草案及修法理由於其全球資訊網1，這次修法條文總數共有19條，其中涉及生命身體法益保護的規範有14條，就修法條文數的比例而言，很明顯的可以知道此次修法的重點主要在於侵害生命身體法益的行為制裁規範。關於生命與身體法益侵害，就刑法分則之殺人與傷害罪章而言，除第285條傳染花柳病罪與第286條妨害幼童發育罪外，相關條文自1935年公布迄今皆未有更動，此次關於殺人與傷害罪章的修法，本應被期待有相當的時代意義，然而仔細對照擬修訂條文的規範內容後，可以發現相關修法並沒有能夠符合現代社會價值變動，全面調整規範體系，落實生命、身體法益之維護。
