    Title: 談都市更新權利變換之若干法律議題

    Abstract: 都市更新事業之實施，固可增進公益，但亦影響更新範圍內及其週邊土地、建築物所有權人或居民之財產權及居住自由。是以，建置確認都市更新事業之公益性與必要性，同時符合憲法保障人民基本權利與自由意旨，且符合正當行政程序之法制是屬重要。然現行都市更新條例自立法之初，即存有不少缺漏，致時生疑義與爭執；是主管機關乃以行政函釋予以補充，嗣雖部分函釋內容納入都市更新權利變換實施辦法等法規命令中，但其適法性仍有待商榷。爰此，本文從法解釋角度，枚舉若干都市更新條例規範下，關於權利變換之法律議題，包括關於不能或不願參與分配土地所有權人之補償基準及其所有權歸屬處理、合法建築物所有權處理等，分析其問題點，以呈顯都市更新條例有關權利變換規定，尚有諸多待補強者。冀期值都市更新條例進行修法之際，有關機關得以再省思其不足之處。
