Title:	民法親屬編規定「使同性別二人間不能成立法律上婚姻關係」違憲疑義解釋案鑑定意見書

Abstract:	本鑑定意見認為︰現行民法確實不許「同性別二人結婚」，本案爭點性質為國家公權力之立法權限制部分人民之婚姻自由。依據大法官過往多次解釋，婚姻自由為憲法第二二條保障之人民基本權利，而婚姻制度是以「人格自由」為基礎，其核心內容為「雙方經營永久共同生活，成為使雙方人格得以實現與發展之生活共同體，此種永久結合關係使夫妻在精神上、物質上互相扶持依存」（釋字第五五四號參照）。大法官過往解釋雖曾提及「一夫一妻」，但都是在聲請人與利害關係人為異性配偶的脈絡下提出，因此大法官尚未有機會針對同性配偶亦可符合上述婚姻制度核心內容的情形表示意見。本鑑定意見認為︰同樣皆可符合上述婚姻制度的核心內容，單純「傳統習俗」或「部分人民道德感情上不舒服的感受」，無法構成對歷史社會上處於弱勢結構之同性性傾向人民予以差別待遇或是限制其婚姻自由的正當目的。現行民法違反憲法保障婚姻自由及平等權之意旨。未來若不許同性性傾向人民結婚，而僅給予非婚姻的同性伴侶制度，亦同樣違反平等原則。
